Overseas Korean's Report of Domestic Residence Application Eligibility

"Korean nationals reside abroad" and "Foreign nationality Koreans" entering Korea with overseas Koreans status (F-4) who wish to be applicable to the Overseas Koreans law. (Overseas Koreans law Article 6-1, hereto referred to as “Overseas Koreans”)

▪ “Korean nationals residing abroad” are Korean nationals who have attained permanent residency status in foreign countries, or who are residing in foreign countries with the aim

of attaining permanent residency status.

Those who have attained permanent residency status of foreign countries are those who have attained long term residency rights from the countries of residence. (the Presidential Decree of the Overseas Koreans Law Article 2-1)

Those residing overseas with aims of attaining permanent residency status are movers as per Emigration law Article 2, who have yet to receive permanent residency status from the country of residence as of yet (the Presidential Decree of the Overseas Koreans Law Article 2-2)

▪ “Foreign nationality Koreans” is Koreans who once possessed Korean nationality, or their immediate descendents who have attained foreign nationalities, but appointed by the Ministerial Ordinance of the Overseas Koreans Law.

Overseas Koreans’ Report of Domestic Residence Reporting period

▪ As Domestic residency reporting is not mandatory, in principle there are no limits to the reporting periods.

▪ Except, where the foreign nationality Korean does not report the local place of residence, they must register as a foreigner within 90 days from the date of entry as per the Immigration Act Article 31.

▪ As per the Immigration Act those who receive foreign Overseas Koreans status (F-4) or receive permissions for change of status, must report the domestic residence upon receiving such permissions.

Method of reporting

▪ Must apply in person at the Immigration Office under the jurisdiction by preparing the following submission documents. (Proxy applications not allowed)

Other documents inspected by the Minister of Justice through Overseas Koreans’ immigration and stay administrative council
